Is there a time limit to collect on a class action settlement?
My husband passed away and he was involved in a class action lawsuit. 2 years after his passing the suit was settled. No one contacted me, when I contacted them they said they tried (it's not too hard to find me) and since I didn't respond they closed the case I was not included. Is there a time limit or anything I can do to get the settlement that is owed to me?
There is a time limit for claiming funds. You need to contact them again. See if you can speak to someone higher up that handled the case. If they don't want to play nice you probably need to retain your own lawyer. You can probably find someone that will do this for a set fee compared to a percentage of you settlement. I don't think they need a percentage as you are already having to give a percentage to the lawyers that are holding the funds. Now, if the funds have already been duly dispense to all plaintiffs you might run into trouble. If you are indeed easy to find(haven't moved and have the same phone numbers as when this all started) then you might have to sue the law firm for not doing their job. Whether or not a settlement for your husband automatically goes to you in the event of his death prior to the settlement I can't say. It depends on the lawsuit.
